TalkToWP provides AI-powered WordPress health monitoring services, including but not limited to:

• Real-time website health monitoring
• Security vulnerability detection
• Performance tracking and analysis
• AI-powered issue explanations and recommendations
• Plugin and theme update notifications
• Incident detection and alerting

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

4. Subscription and Payment

4.1 Pricing

Our Service offers the following pricing structure:

• Free Plan: One WordPress site with basic monitoring features at no cost
• Pro Plan: $5 USD per site per month for additional sites with all features
• New users receive a 30-day free trial of the Pro Plan

4.2 Billing

Subscriptions are billed monthly through Paddle. The billing amount adjusts automatically based on the number of sites you monitor. You authorize us to charge your designated payment method for all fees incurred.

4.3 Refunds

Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for any illegal or unauthorized purpose
• Resell or redistribute the Service without authorization

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Beyondt Consultancy & Services Pvt. Ltd. and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYONDT CONSULTANCY & SERVICES PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Beyondt Consultancy & Services Pvt. Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Calcutta High Court, Kolkata, West Bengal, India.
